Make Sure Your Employment Posters are Up-to-Date
Federal “Know Your Rights” Poster. Employers with at least 15 employees are required to post the Equal Employment Opportunity Commission's new mandatory “Know Your Rights” poster. The EEOC has replaced the “Equal Employment Opportunity is the Law” poster with the “Know Your Rights: Workplace Discrimination is Illegal” poster. Employers should make sure the new version, with an October 20, 2022, revision date, is posted. The South Dakota Department of Labor offers a compliance poster that meets all federal poster requirements at no charge, which they are updating to include the EEOC updates.

South Dakota Minimum Wage: There is no state requirement for the state minimum wage posting; but the South Dakota Department of Labor provides a poster as courtesy and their new poster reflects the new minimum wage for the year.
Non-tipped Employees: Effective Jan. 1, 2023, the minimum wage for non-tipped employees in South Dakota is $10.80/hour.
Tipped Employees: Effective Jan. 1, 2023, the hourly minimum wage for tipped employees is no less than $5.40/hour.
